General Terms and Conditions (GTC)

1. Scope

These terms and conditions apply to all contracts between Petsamor Co., Limited and consumers concluded through our online shop.

2. Conclusion of the contract

The presentation of goods in the online shop does not constitute a legally binding offer. By submitting an order, the consumer makes a binding offer to conclude a purchase agreement. The contract is only concluded upon confirmation of shipment.

3. Prices and payment terms

All prices include statutory VAT (where applicable), but exclude shipping costs.
The prices quoted at the time of ordering apply.

4. Retention of title

The goods remain our property until full payment is received.

5. Delivery and Shipping

Delivery will be made to the delivery address specified by the consumer.
Partial deliveries are permitted, provided they are reasonable and do not incur additional costs.

6. Statutory Warranty

Consumers are entitled to statutory warranty rights in accordance with §§ 437 ff. of the German Civil Code (BGB).
The warranty period is two years from delivery of the goods.
In the event of a defect, the consumer is initially entitled to subsequent performance (repair or replacement).
If the subsequent performance fails, the consumer can reduce the purchase price or withdraw from the contract.

7. Warranty

A manufacturer's warranty extending beyond the statutory warranty is only granted if expressly stated in the product description.
Without an explicit warranty statement, there is no additional manufacturer's warranty.

8. Liability

We are liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on an intentional or grossly negligent breach of duty.
We are liable for slight negligence only in the event of a breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable damages typical for this type of contract.
Any further liability is excluded.

9. Product Use

The consumer is obliged to use the goods in accordance with the enclosed instructions and safety information.
We accept no liability for damage resulting from improper use.

10. Electrical and Electronic Equipment Act (WEEE)

We are registered with the EAR Foundation in accordance with the German Electrical and Electronic Equipment Act (ElektroG).

According to the German Electrical and Electronic Equipment Act (ElektroG), old electrical and electronic equipment must not be disposed of with household waste. It can be taken to municipal collection points.

11. Battery Act (BattG)

Batteries and rechargeable batteries must not be disposed of with household waste. Consumers are legally obligated to return used batteries.
The battery can be returned free of charge to the appropriate collection points.

12. Packaging Act (VerpackG)

We are registered with the Central Agency Packaging Register (LUCID) in accordance with the German Packaging Act (VerpackG) and are affiliated with a dual system.

13. Place of jurisdiction

For consumers, the law of the country in which the consumer has their habitual residence applies.
For entrepreneurs, the place of jurisdiction is Hong Kong.

14. Severability Clause

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
